RELEASE OF LIABILITY

In exchange for participation in the Escape Room Event organized by Break Free Escape Games, LLC (hereinafter: Break Free) and/or use of the property, facilities and services of Break Free, I agree for myself and (if applicable) for the members of my group, to the following:

1. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Break Free, their employees, representatives, or agents of Break Free.

2. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury including Covid-19 or other sickness to myself and (if applicable) my family and other group members, and further release and discharge Break Free for injury, loss or damage arising out of my or my group's use of, or presence upon the facilities of Break Free, whether caused by the fault of myself, my group, or other parties.

3. I agree to indemnify and defend Break Free against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my group's use of, or presence upon the facilities of Break Free.

4. I agree to pay using my credit card on file (or bill, if no credit card) for all damages to the facilities of Break Free caused by me or my group's negligent, reckless, or willful actions.

5. Any legal claim that arise from participation in the escape room or any event taking place therein or in relation to Break Free, shall be resolved under New Hampshire law.

6. I agree that Break Free, or the employees, representatives, or agents of Break Free, has the right to any photos or any video/sound footage of me during the Break Free event. These photos, video footage, and sound materials may be used for legal, insurance, and marketing purposes.

7. I acknowledge that all individuals under the age of 18 will be accompanied by a paying responsible adult at all times while in the attraction or on the premises. 

8. I acknowledge that there are no cash or credit card refunds. Any advanced cancelations will be refunded with a voucher code good toward a future visit with no expiration date. Last second cancellations and no shows will result in no refund or credit. 

9. I acknowledge that there is 24-hour recorded video and audio surveillance of all areas at Break Free and that I will be recorded, and that these recordings will be used by Break Free for legal, insurance, and marketing purposes.

10. I agree and acknowledge that I am under no pressure or duress to accept this Agreement and that I have been given a reasonable opportunity to review it and have my group review it before continuing to payment. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Break Free has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I ALSO CONFIRM THAT I HAVE EXPLAINED THESE TERMS TO ALL OTHER MEMBERS OF MY GROUP. LASTLY, I UNDERSTAND THAT BY PROCEEDING WITH AND PAYING FOR THIS BOOKING I, ALONG WITH THE REST OF MY GROUP, AGREE TO THESE TERMS AND VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
